Accessory Building Permit and Permanent Roadside Stand Application

Only one accessory building incidental to a principal structure is allowed  in any residential or agricultural residential zoning.


Accessory buildings can not be used or developed as a second  dwelling on a property unless a conditional use permit is obtained from town board or it is exempted  under Sec 60-61 (b)(4) that allows a parent or child of the owner who resides on the parcel may develop a dwelling unit according to requirements in the R-1 District.


The size of such structures are limited by  the size of the property upon which it is located.  ACRES can be calculated by taking the width of the parcel in feet times the depth of the parcel in feet. That total is divided by 43560 to get number of acres.

Maximum size of accessory building is based on parcel size.

Accessory buildings on parcels under 1.5 acres must be less than 1500 square feet.

Accessory buildings on parcels  between 2.5 acres to 3.5 acres must be less than 2500 square feet.

Accessory buildings on parcels  between 3.5 acres to 4.5 acres must be less than 3500 square feet.

Accessory buildings on parcels  between 4.5 acres to 5 acres must be less than 4500 square feet.

Accessory buildings on parcels  over 5  acres are not limited to number of  buildings or size. 


Maximum height for accessory buildings is limited to 20 feet on parcels under 5 acres.
